A judge has dismissed the murder charge against one of the defendants in the shooting death of Asiyanna Jones.

The judge ruled that prosecutors failed to provide enough evidence to support the indictment against Elizabeth Perez, report NewsChannel 13’s media partners at The Berkshire Eagle.

The paper reports that Perez’s defense attorney argued the Berkshire County district attorney was unable to prove Perez fired a gun, or that she knew anyone on the scene had a weapon.

Jones was killed on October 2, 2017. She was a bystander, shot in the head during a shootout in Pittsfield.

Both Gary Linen and Casey Pilot are still on trial for Jones’ murder.
