The Saratoga County District Attorney’s Office has appointed an Albany attorney to appeal the dismissal of the indictment against the man involved in a shootout in downtown Saratoga Springs last year.
Matthew Hug has been hired to file the appeal of Judge Jim Murphy’s dismissal of the charges against Vito Caselnova. The off-duty Rutland County Sheriff’s deputy was seen on video firing several shots.
However, Murphy found serious errors in the DA’s presentation of the case to the grand jury and threw it out.
On Tuesday, NewsChannel 13 spoke with Hug, who said he expects file a motion within the next 60 days.
