Opening statements delayed in Saratoga Springs wrongful death case

Opening statements in the wrongful death lawsuit of Darryl Mount were delayed on Tuesday.

One of the attorneys had an emergency and the jury was dismissed for the day, according to the Saratoga Supreme Court clerk’s office.

His family is suing the Saratoga Springs Police Department, officers and the city self. They claim that Mount was beaten by police following a chase on Aug. 31, 2013.

Mount was found face down after climbing over a fence in a construction site. He survived the fall but was confined to a wheelchair before dying in May 2014

His family is claiming that Mount was beaten and attorneys for the city are saying he fell from a scaffold.

Court is scheduled to resume on Wednesday. The trial is expected to last for about two weeks.
