Truck driver won’t face charges in deadly Pittsfield dirt bike crash

No criminal charges will be filed after a truck struck and killed a dirt bike rider in Pittsfield in May.

The Berkshire County District Attorney’s Office announced that the truck driver’s operation of his vehicle did not meet the legal criminal standard of negligence.

John Tyska, 34, died when he rode his dirt bike into a truck on May 25 in the area of West Housatonic Street around 6:50 p.m. Tyska was making a fast turn from Plymouth Street onto West Housatonic Street, according to investigators. 

Invesgiators said that Tyska was traveling around 55 to 65 mph at the time of the crash. The speed limit on that stretch of road is 40 mph.

The DA’s office also said Tyska was driving in a manner to avoid police, including going through a red light at on West Street at about 60 to 70 mph.

The truck driver did not have much reaction time to avoid the crash, investigators said.
