No criminal charges after intruder killed in Adams fight

The Berkshire County District attorney’s office will not be pursuing criminal charges in the death of Mark Bednarz.
He died after a violent fight with a man in Adams.
The homeowner told NewsChannel 13’s Dan Levy back in February his home was under attack more than once by Bednarz.
He put up surveillance cameras, then told us he spotted Bednarz coming and going from his home on at least two other occasions.
He came home in February to find Bednarz drilling into his gun safe, and told NewsChannel 13 it looked like he was on something.
It led to a half-hour fight involving a baseball bat, an electric drill and a soup can.
Both men were taken to Berkshire Medical Center, where Bednarz died the next day.
The medical examiner ruled Bednarz exact cause of death to be fentanyl intoxication due to recent cocaine use and asphyxiation.
