A Berkshire County man who police said struck and killed a man on a mobility scooter last month has been charged with leaving the scene of the crash.

Dyvine Smythe, 24, of Adams, is accused of striking 72-year-old David L. Frye with his 2014 Dodge Ram, according to our media partners at The Berkshire Eagle.

The crash happened on May 28 around 7 p.m. as Smythe was turning right onto Second Street from Wallace Place. Smythe then left the scene, according to the Berkshire County District Attorney’s Office.

Smythe has a prior history of traffic violations, the paper reported, including unlicensed operation of a motor vehicle in 2019. Smythe received one month of probation.

He had a misdemeanor negligent operation of a motor vehicle charge in 2021 and was accused of failing to stop for police. Smythe received probation in that case too.

He also was indicted in February 2020 in connection with an armed robbery at a boat camp. He was sentenced to two years of probation.
