Dontie Mitchell's attorney is seeking to keep certain evidence out of his attempted murder trial.

Self-proclaimed anti-violence activist Dontie Mitchell is fighting to keep certain evidence out of his attempted murder trial.

Mitchell’s attorney, Rebecca Sokol tells 13Investigates that she is challenging a search warrant for his Mitchell’s personal items including cell phone and laptop. She is also challenging if the arrest was done properly.

Sokol made her request during a court hearing Thursday afternoon.

This case is involving Mitchell’s involvement in a Cohoes shooting that took the life of X last summer.

Mitchell is now charged with attempted murder after the initial charge of second degree murder was dropped because of insufficient evidence. A judge has not yet made a decision on Sokol’s challenges.

A trial date has not yet been set either, but 13 investigators is learning there could be a date soon.

Mitchell is also charged with criminal sex act in a separate case that alleged crime happened in 2021 in Albany. No other details on that case have been released.
