A judge denies request to drop murder charges against a Pittsfield man.

A judge in Berkshire County has denied a request to dismiss a case against a murder suspect in Pittsfield.

Prosecutors found enough evidence to support a murder indictment against Naquan Miller. Miller is one of four men accused of killing Reymon Delacruz-Batista, 32, back in 2021, according to NewsChannel 13’s media partners at The Berkshire Eagle.

Delacruz-Batista was the operator of two barbershops. He was shot to death in December 2021 and his body was abandoned in a parking lot in the Pittsfield State Forest.

Court documents show Miller’s lawyers had asked the judge to drop charges against him. The motion to dismiss was not made public.

Prosecutors had presented sufficient evidence to support the indictments against Miller on charges of murder, armed kidnapping with serious bodily injury, accessory before the fact, accessory after the fact and withholding evidence from an official proceeding, according to Judge John Agostini.

The trial is set to start in November.
