Five correction officers in beating death of inmate get more time to consider plea offers

Five corrections officers were in Oneida County Court on Tuesday morning to answer about whether they have accepted plea offers in the deadly beating of a Marcy Correctional Facility inmate in December.

Correction officers were seen on body camera video kicking and punching Robert Brooks on Dec. 9.  He died the next day at a hospital.

Some of the correction officers told the judge on April 15 that they needed more time to consider the offers. The judge said he would need an answer for them by Tuesday.

Attorneys for Nicholas Gentile, Anthony Farina. David Kingsley, Nicholas Kieffer and Matthew Galliher gave various reasons why they couldn’t decide on the plea offer. They included needing more time to review some discovery material they received from the prosecution on Tuesday morning and having technical issues in accessing the material that had already been turned over to the defense.

The judge told them all to come back on May 13, and the prosecution agreed to leave the offers on the table until then.

If the offers are rejected at that time, attorneys will have to file motions that day.

More officers are set to appear in court on Wednesday, according to the court calendar.
