Public defender recently thrown from court now charged with criminal contempt
Two weeks after area public defender Timothy Berry was physically removed from an Albany County courtroom in front of a NewsChannel 13 camera, he was officially held in criminal contempt.
Berry went into a lengthy political tirade in front of state Supreme Court Justice Thomas Marcelle during a sentencing hearing on April 8 for Daquan Arrington, who had pleaded guilty to manslaughter.
Arrington’s sentencing was postponed.
Berry appeared before Judge Marcelle on Tuesday to apologize.
In legal terminology, Berry’s statement to the judge is known as “purgation.”
Even though the contempt ruling remains on Berry’s record, and he will face a monetary penalty, he is also free to continue practicing law. However, another instance of contemptuous behavior could lead to a stiffer penalty.
