Names released of officers, nurse under investigation for inmate’s death

The names of the 14 people under investigation for an inmate’s death at Marcy Correctional Facility have been released. They include 13 corrections officers and a nurse.

The following people have been suspended without pay or resigned in connection with the death of Robert Brooks:

  • CO Matthew Galliher
  • CO Nicholas Anzalone
  • CO David Kingsley
  • CO Nicholas Kieffer
  • CO Robert Kessler
  • CO Michael Fisher
  • CO Christopher Walrath
  • CO Michael Along
  • CO Shea Schoff
  • CO David Walters
  • Nurse Kyle Dashnaw
  • CO Anthony Farina (resigned prior to suspension / termination)

As NewsChannel 13 has been reporting, Robert Brooks was brutally beaten by officers inside the jail, last month. Brooks had been serving a 12-year prison sentence since 2017 for first-degree assault. He had just been transferred to the prison from another facility.

The beating was caught on disturbing body cam video. However, all the cameras were in “standby” mode at the time, and no audio was recorded.

Attorney General Letitia James announced earlier this week she is recusing herself from the case and appointing a special prosecutor from Onondaga County, because her office is already representing four of the officers under fire. Some have been defendants in brutality lawsuits other prisoners filed.

Meanwhile, Gov. Kathy Hochul said she was “outraged and horrified” by the videos.

“The video of this horrific attack demonstrates that crimes clearly were committed, and I believe initial charges can be brought even as more serious charges are considered based on further investigation,” Hochul said.

As governor, Hochul has no authority over the special prosecutor to bring criminal charges herself.

Preliminary findings found “concern for asphyxia due to compression of the neck as the cause of death, as well as the death being due to actions of another.” However, the final results of the autopsy haven’t been released.
