Report: Hussain’s Schoharie limo crash appeal set for Sept. 6

Sept. 6 is when a state appellate court is scheduled to hear Nauman Hussain’s appeal in the Schoharie limo crash, according to the Times Union.

Hussain was convicted of 20 counts of manslaughter in May 2023, and sentenced to five to 15 years in prison.

Hussain’s lawyer plans to make the case next month that the trial was unfair and Hussain’s conviction should be overturned.

However, a lawyer representing Schoharie County District Attorney Susan Mallery plans to argue the opposite, the Times Union reported.

In the appeal, Hussain’s lawyer said the instructions given to the jury on how they could reach a conviction were unfair. He also claims the court refused to allow Hussain more than 20 minutes to decide whether or not to withdraw a plea.

His lawyer said he was rushed into withdrawing his previous guilty plea to 20 counts of criminally negligent homicide in August 2022.

The original plea deal, which would have kept Hussain out of prison, was thrown out by Justice Peter Lynch during that hearing.

The Times Union is reporting that prosecutors believe Hussain’s legal team did not do enough at the time to complain about the lack of time they were given.
