Attorneys for the off-duty Rutland County sheriff’s deputy accused of attempted murder want his alleged victims charged with gang assault.
A court filing just obtained by NewsChannel 13 spells out how attorneys for Vito Caselnova think prosecutors had their minds made up and didn’t let grand jurors know they could also charge Alex Colon and two others with attempted murder and gang assault.
This filing is a supplement to a defense motion last week asking the court to dismiss the indictment against Caselnova, accusing the district attorney of prosecutorial bias.
The defense argues that Colon was the initial aggressor, not Caselnova.
