It’s been exactly one year since the big shootout in Saratoga Springs that left three people with gunshot wounds and four people under arrest.  But tonight, the criminal cases remain largely unresolved.

Two of the three men from Utica, Alexander Colon and Christopher Castillo are scheduled to appear in court Tuesday to answer charges of misdemeanor attempted assault.  Police say Colon exchanged gunfire on Broadway at about 3 a.m. on Nov. 20.

The other alleged shooter, Vito Caselnova, an off-duty Rutland Vermont sheriff’s deputy from Glens Falls, was accused of attempted murder. But the county judge dismissed the indictment against Caselnova, finding the Saratoga County District Attorney’s Office’s presentation of the evidence was flawed and
unfair.

The district attorney is planning to appeal the judge’s decision.

Darius Wright, the other man from Utica, pleaded guilty earlier this month to attempted assault and paid a $250 fine.
