Watervliet man sues apartment complex after roof collapse

The man whose roof collapsed right into his apartment,, showering his stuff with all sorts of debris, is now suing.

The man whose roof collapsed into his Watervliet apartment six months ago is now suing the property owner.

Brandon Gayzur is demanding no less than $250,000 in damages from his former apartment complex, Lake Shore Park Apartments in Watervliet.

The 28-page lawsuit filed on Tuesday  details what Gayzur has called a “nightmare situation.”
Gayzur was told by Lake Shore Park Apartments that the roof was going to be replaced on his unit in July 2024.

However, the result did not go as planned. and it damaged many of his valuable belongings.

Gayzur is also suing Babe Roof, which was contracted to do the repairs.

The lawsuit states Gayzur was without a home for many weeks as his home was being inspected by the complex’s insurance adjusters. Gayzur says he stayed in his car, Airbnb’s and couch surfing.

Lake Shore Park Apartments offered Gayzur an option to end his lease, but Gayzur wanted to keep the apartment and wait for the repairs to be done.

Gayzur later found out from the complex his home tested positive for asbestos. In the end, Gayzur’s lease was terminated.

Lake Shore Park Apartments declined to comment on the new lawsuit.

13Investigates looked at Gayzur’s lease agreement. It says the complex is not responsible to any tenant’s damage or loss of property or personal injury for a list of reasons.

Tenants are required to have renters insurance at Lake Shore Park Apartments.

Gayzur’s renters insurance denied his claim, citing there is no coverage available for loss in his policy.

NewsChannel 13 also reached out to Babe Roof Tuesday evening after its normal business hours. We have not yet received a reply on our request to comment. If we do, we will share what they say on the lawsuit.
