An appeals court has reversed a manslaughter conviction for an Albany man because of an error by the judge.
The appeals court ruled Judge Roger McDonough did not properly instruct jurors about Stephan Harris’ argument that he was acting in self-defense when 26-year-old Jonathan Weldon was killed in 2017.
The appeals court did note that there was enough evidence to support the verdict, but still ordered it be reversed.
Harris could get a new trial.
