NewsChannel 13 has learned a special prosecutor will take over the case of Samantha Guerra.
She is the Republican who ran for Saratoga Springs City Council and was accused of altering petitions.
Guerra is facing two misdemeanor charges of misconduct and is scheduled to appear in court later this week.
Saratoga County District Attorney Karen Heggen, who is also a Republican, has asked for a special prosecutor to handle the case.
Heggen tells NewsChannel 13 her office has a conflict, so she asked the court to appoint Schenectady County District Attorney Bob Carney to prosecute the case.
