DA: Saratoga Springs man likely did not intend to kill roommate with pellet-style gun
It appears that the Saratoga Springs man charged in the deadly shooting of his roommate did not intend to kill the man, according to prosecutors.
Brendan Carl shot Michael Collins in the back with a pellet-style long gun at 66 Warren St. at around 2:30 a.m. on Sunday, police said. Carl called 911 to report what had happened.
Police arrived to find Collins unresponsive. He was taken to Albany Medical Center, but he was pronounced dead shortly after getting there.
Carl was charged with second-degree manslaughter and criminal possession of a weapon.
“It’s our understanding is that the defendant and the victim knew each other, that this was not a confrontational situation – at least that’s what the initial investigation reveals,” Saratoga County District Attorney Karen Heggen said. “It’s always a tragic situation. It doesn’t matter whether you know someone or not.”
A second-degree manslaughter charge alleges that a person engaged in conduct in a reckless fashion that resulted in the death of the victim. It carries a maximum sentence of 5 to 15 years in state prison.
Carl is scheduled to be Saratoga Springs City Court on Tuesday morning.
