Court appearance for man accused in dirt bike hit-and-run

The Watervliet man accused in a dirt bike hit-and-run that left a UAlbany student seriously injured was back before a judge Monday.

Austin Breyette of Watervliet, the man accused of hitting and severely injuring a UAlbany student with a dirt bike was in Albany County Court Monday morning.

He appeared before Judge William Little in shackles, in a yellow jail jumpsuit, and with his hair back.

Breyette, 25, is accused of driving the dirt bike that slammed into UAlbany student Alexa Kropf, 19, on Hudson Avenue in Albany in April, leaving her with serious injuries, including a fractured pelvis. She had to have brain surgeries.

The two friends with her the night of the crash said that after the biker hit her, he gave them the finger and took off.

Attorney Jasper Mills was recently retained by Breyette’s family to represent him.

“And today was a very simple appearance,” he said. “Today was for a certificate of compliance. The people are essentially saying that they’re ready for trial, and that they provided us with all the necessary discovery needed for trial, and I preserve the right to challenge that.”

The most serious charge Breyette is facing is assault in the second degree. There is also leaving the scene of an incident without reporting, and two counts of tampering with physical evidence.

His attorney asks people not to rush to judgment.

“I try to treat people that way I would want to be treated, and I wouldn’t want my friends or family member or daughter to be injured in that fashion,” said Mills. “But I think that the question would be, given the circumstances, is this a criminal matter in regard to how the injuries were caused versus a civil matter. So that has to be played out, and we’ll work through it, and we’ll work with the DA’s office, and we’ll see what happens.”

Kropf is back home on Long Island. She is set to have another brain surgery at the end of this month.
