Man gets 1 to 3 years in prison in connection to 6-week-old baby’s death
The former Cohoes man who fled to Mexico with his husband, after they were charged in the death of a 6-week-old baby was sentenced on Friday to 1 to 3 years in prison.
Neil Garzon had previously pleaded guilty in Albany County Court to child endangerment and attempted hindering prosecution.
Baby Eli died in 2019 at the couple’s home. Garzon’s husband, Anthony Ojeda, had admitted to putting a pacifier into a bag of methamphetamine and giving it to the baby. The infant had toxic levels of the drug in his system and injuries to his head and ribs.
Ojeda was arrested in June 2021 and charged with second-degree murder, manslaughter and endangering the welfare of a child. Garzon was arrested at that same time and charged with endangering the welfare of a child.
The couple was released on conditions. They fled to Mexico and were on the run for almost two years. They were finally captured in Mexico in January 2024.
Ojeda was sentenced earlier this month to 20 years in prison
