Pretrial hearing held in case of man who allegedly struck UAlbany student with dirt bike

A pretrial hearing was held Thursday in the case of the Watervliet man accused of hitting and severely injuring a UAlbany student with a dirt bike.

A pretrial hearing was held Thursday in the case of the Watervliet man accused of hitting and severely injuring a UAlbany student with a dirt bike.

Austin Breyette, 26, is accused of hitting Alexa Kropf just before midnight on April 26. Kropf had serious injuries, including a fractured pelvis and required several brain surgeries.

Breyette is facing charges of second-degree assault, leaving the scene of an incident without reporting and two counts of tampering with physical evidence. He allegedly hid the dirt bike to conceal the crime.

Breyette’s attorney, Jasper Mills, said the hearing’s purpose was to review evidence coming into the trial and witnesses who would be testifying.

The video of the incident was played in court. Mills said the crash was an “extremely unfortunate incident.”

“Before we rush to judgment, it’s important we know exactly what happened and that video would be proof of it,” he said.

The next step is for further motions to be filed in the coming weeks.

The Albany County District Attorney’s Office declined to comment on the hearing.

Kropf was planning to continue her studies at UAlbany online as she recovered at her Long Island home. She is in her second year.
