Documents: Malta man shot and killed by police had punched person at same apartment complex in February
The Malta man shot and killed on Thursday after police said he pointed a BB gun at them was arrested two months ago for allegedly punching someone at the apartment complex, NewsChannel 13 has learned.
Brandon R. Moore, 37, was killed at Ellsworth Common Apartments. State Police said troopers responded to a domestic incident at around 9 a.m. Moore initially barricaded himself in the apartment, and then when he did come out, he aimed the gun at police. They fired their weapons and killed him.
Two troopers had minor injuries. The victim of the domestic incident is not currently in the hospital, police said.
This was the second encounter in as many months that State Police had with Moore. Police said that Moore had been arrested on Feb. 5 in connection with an assault on Feb. 1.
It started with some type of argument at the complex’s dog park. The person who was punched said someone was holding the dog park fence door shut and arguing with a woman who was attempting to enter, according to court documents.
The victim tried to get the two women to stop arguing, and they said that the situation was not that big of a deal. The woman said: “Just wait until my boyfriend gets here!” Then, Moore approaches the fence and punches the victim with a closed fist over the gate, according to court documents.
The person making the complaint punches Moore in retaliation. Moore than punches him repeatedly in the face, striking both of his eyes, left ear and nose. He then allegedly throws the victim to the ground, court documents said.
The person making the complaint said he saw the female punching someone in the head while they were on the ground. The woman stopped hitting the person and exited the dog park with her boyfriend, Moore, the deposition goes on to say.
The victim said his girlfriend got punched in the face.
NewsChannel 13 is also learning that Moore worked at GlobalFoundries. Company spokeswoman Julia Moynehan said that the company is cooperating with law enforcement teams.
“As this is an ongoing investigation, we cannot comment further at this time. We take this matter very seriously and are committed to providing support to our impacted employees,” she said in an email.
