The Troy mayor will allow some residents to move back into the Harbour Point Gardens Apartments.
Residents were evacuated without notice more than three weeks ago.
Troy Mayor Patrick Madden sent them a letter on Tuesday, saying the building code department met on-site Monday with the property managers, including their engineer.
They were able to clear five units for re-occupancy, he said.
Their engineer is aiming to have permit drawings to the city by the end of this week, said the mayor, who adds, they are prioritizing the violations that keep the residents from their homes.
Madden said he is here for residents who are struggling, and is apologizing for what residents had to endure.
