Special prosecutor assigned to handle latest appeal of convicted axe murderer
A special prosecutor has been assigned to handle Christopher Porco’s latest appeal of his murder conviction.
Porco was convicted in 2006 for killing his father with an axe and severely injuring his mother in the overnight hours of Nov. 14, 2004 in their Bethlehem home. He has attempted several times to overturn his conviction.
This appeal once again claims that Porco was ineffectively represented by his trial attorney, Terry Kindlon, whose son Lee Kindlon is now Albany County District Attorney.
Christopher Horn from the Schenectady County District Attorney’s Office has been assigned to handle the case as a special prosecutor in Albany County Court. Horn had handled the prosecution response to Porco’s previous appeals when he worked in the Albany County DA’s office.
Horn told NewsChannel 13 that this latest appeal rehashes previous argument. He pointed out that the state’s highest, the Court of Appeals, had previously ruled that Terry Kindlon was effective in representing Porco.
“The argument that Terry Kindlon was ineffective at trial is absurd. Terry Kindlon is one of the premier defense attorneys in the area. The evidence against Christopher Porco was overwhelming,” Horn said.
Both sides have been given more time to file motions.
