Inmate gets longer sentence for sexually abusing mentally disabled person

A former Albany man already facing potentially life in prison was sentenced on Friday to another 7 years for sexually abusing a mentally disabled person. Carl Barton, 58, was convicted in April of criminal sex act and sexual abuse. Prosecutors said that on Nov. 30, 2020, while at a residence on Morris Street, Barton had sex with a person who was incapable of consent, according to the Albany County District Attorney's Office.

A former Albany man already facing potentially life in prison was sentenced on Friday to another 7 years for sexually abusing a mentally disabled person.

Carl Barton, 58, was convicted in April of criminal sex act and sexual abuse. Prosecutors said that on Nov. 30, 2020, while at a residence on Morris Street, Barton had sex with a person who was incapable of consent, according to the Albany County District Attorney’s Office.

This sentence will run consecutive to a sentence of 30 years to life that Barton is already serving for two previous convictions – 25 years to life for predatory sexual assault and 5 years for attempted criminal possession of a controlled substance.

Judge Roger McDonough had harsh words for Barton before handing down the sentence.

“He is clearly an individual who cannot function in society without attempting to, or actually preying on other members of society,” McDonough said.
